The advocacy mediation process operates through a strategic partnership between an attorney (the advocate) and their client, running parallel to the standard mediation framework but focused entirely on maximizing the client’s outcome. It begins long before the session with intensive pre-mediation preparation. During this phase, the advocate shifts away from traditional courtroom tactics and instead helps the client define their core underlying interests, identify realistic compromises, and calculate the true financial and emotional costs of losing at trial. The advocate then drafts a confidential mediation statement for the mediator, highlighting the strengths of the client’s case while signaling a genuine willingness to engage in collaborative problem-solving.
Once the session begins in the joint meeting, the advocate delivers an opening statement designed for a unique audience: the opposing party, rather than a judge. A skilled advocate presents their client’s positions firmly but uses a civil, non-adversarial tone to avoid triggering defensiveness or shutting down negotiations. By framing the dispute as a shared problem requiring a mutual solution, the advocate sets a cooperative tone while ensuring the client’s rights and baseline demands are clearly understood by everyone in the room.
The process shifts into high gear during the private caucuses, where the advocate uses the mediator as a strategic diplomatic asset. Behind closed doors, the advocate manages the client’s emotional responses and works with the mediator to test different settlement options. Instead of drawing hard lines in the sand, the advocate engages in interest-based bargaining—uncovering creative, non-monetary solutions (such as contract restructuring or mutual releases) that a rigid court ruling could never provide. By combining a clear-eyed risk analysis of the litigation with skilled, collaborative negotiation, the advocate guides the client toward a favorable, signed agreement that protects their long-term interests.
